Terms of Service

These terms govern the use of Brewquester as a digital coffee tracking and workflow app, including accounts, workspaces, uploads, AI-assisted functions, and optional paid features.

1. Provider and scope

Brewquester is provided by Mats Echterhoff, c/o Chatbyte GmbH, Mühlenkamp 31, 22303 Hamburg, Germany. Contact: support@brewquester.com. These Terms apply to the Brewquester website, app, accounts, workspaces, uploaded content, AI-assisted functions, and optional paid features for self-serve users.

2. Subject of the service

Brewquester is a digital coffee tracking and workflow app. The app may include functions for recording coffee, brewing sessions, equipment, notes, workspaces, uploads, insights, and AI-assisted suggestions. The concrete functions of Brewquester may evolve over time. Brewquester is not professional, legal, financial, medical, safety, or nutrition advice.

3. Account, registration, and eligibility

An account is required to use the logged-in Brewquester app. Users must provide accurate account information, keep it up to date, and keep login credentials confidential. Brewquester may be used by persons aged 16 or older. Users under 18 may book paid features only with consent of a legal guardian or where they can legally enter into the contract. Users are responsible for activity under their account unless the activity was caused by Brewquester's breach of duty.

4. Workspaces, content, and uploads

Users may create or join workspaces and store coffee-related records, notes, uploaded media, and other content in Brewquester. Users are responsible for the content they enter, upload, or share through Brewquester and must have the necessary rights and permissions for that content. Workspace owners and admins are responsible for managing members, roles, access, invitations, and ownership transfers within their workspace.

5. Acceptable use

Users must not misuse Brewquester, interfere with its operation, bypass access controls, attempt unauthorized access, or use automated access in a way that harms availability, security, or other users. Users must not use Brewquester to store, upload, or transmit unlawful, infringing, harmful, malicious, privacy-invasive, or otherwise unauthorized content. Users must not upload images, notes, or other content containing unrelated personal, confidential, or third-party-sensitive information unless they are entitled to do so.

6. AI-assisted features

Brewquester may provide AI-assisted functions, such as suggestions or extraction of editable coffee-related information from user-provided content. AI output can be incomplete, inaccurate, or unsuitable. Users must review and correct suggestions before saving, using, or relying on them. Brewquester does not use AI-assisted functions to make legal, financial, health, employment, credit, or similarly consequential decisions about people. Brewquester may limit or disable AI-assisted functions for security, quota, provider, reliability, legal, or product reasons.

7. Free and paid features

Brewquester may offer free and paid functions. Paid features may be subject to feature limits, usage rules, billing periods, trial periods, renewal terms, or other commercial conditions. The applicable price, taxes, billing period, renewal rules, feature limits, trial conditions, payment details, and order information are shown before a paid order is placed or in the account/billing flow.

8. Contract formation for paid services

A contract for paid features is formed when the user completes the order process, accepts the applicable terms, and the order is confirmed by Brewquester or the payment flow. Before placing a paid order, users receive the essential information for that order, including the paid feature, price, taxes where applicable, billing period, renewal terms, and cancellation options.

9. Prices, taxes, payment, and invoices

Prices and taxes are shown in the order or account/billing flow. Unless stated otherwise there, recurring fees are charged for the selected billing period. Payment processing may be handled by an external payment provider. Users must keep their payment information valid and up to date where a paid recurring subscription is active. Invoices, receipts, or order confirmations may be provided electronically where available or legally required.

10. Term, renewal, and cancellation

Recurring paid subscriptions run for the billing period shown during purchase and renew automatically unless cancelled before the end of the current billing period, unless a different rule is shown during purchase. Users can cancel recurring paid subscriptions through the account or billing area, or through another clearly provided online cancellation route. After cancellation, paid access may continue until the end of the already paid billing period unless the order flow or mandatory law provides otherwise.

11. Withdrawal rights and refunds

Consumers may have a statutory right of withdrawal for paid digital services. The separate Withdrawal Instructions explain this right for paid Brewquester digital features and subscriptions. The applicable withdrawal information is also provided during the order process where required. For digital services, Brewquester may ask users during checkout to consent to immediate performance and to acknowledge that the withdrawal right can expire once the statutory requirements are met. Refunds are granted where legally required or where expressly stated in the order, checkout, account, or billing flow.

12. Availability, maintenance, and product changes

Brewquester may improve, modify, add, restrict, replace, or discontinue functions where this is reasonable, legally required, technically necessary, security-relevant, or part of product development. Brewquester does not guarantee uninterrupted availability. Maintenance, incidents, provider outages, security measures, or technical changes may affect access. Paid core functionality will not be materially impaired without the notice, rights, or remedies required by applicable law.

13. Account deletion and data export

Users may request account deletion or use account deletion functions where available. Account deletion may require resolving workspace ownership or other legitimate interests first so other users' data is not unexpectedly removed. Data export is handled as described in the Privacy Policy or through the support/privacy contact provided by Brewquester. Brewquester may suspend or terminate access where users materially breach these Terms, misuse the service, create security risks, or where suspension or termination is required by law.

14. Rights in the app and user content

All rights in Brewquester, including the app, software, design, documentation, and related materials, remain with Brewquester or the respective rights holders. Users retain their rights in the content they enter or upload. Users grant Brewquester the rights necessary to store, process, display, transmit, and technically adapt that content to provide and operate the requested functions. Brewquester may use aggregated or anonymized usage and quality information for operation, security, analytics, and product improvement where no personal reference is made.

15. Privacy

Information about the processing of personal data is provided in the Privacy Policy. Users are responsible for ensuring that they may lawfully enter, upload, or share personal data of third parties through Brewquester.

16. Liability

Brewquester is liable without limitation for intent, gross negligence, injury to life, body, or health, guarantees expressly assumed, liability under the Product Liability Act, and other mandatory statutory liability. In cases of slight negligence, Brewquester is liable only for breach of material contractual duties whose fulfillment enables proper performance of the contract and on whose compliance users may regularly rely. In such cases, liability is limited to the typical, foreseeable damage. Any further liability is excluded to the extent permitted by law. Mandatory consumer rights remain unaffected.

17. Changes to these Terms

Brewquester may update these Terms with effect for the future where there is a reasonable reason, for example due to product changes, legal requirements, technical developments, or changes to paid features. Material changes will be communicated as required by applicable law. If a change requires consent, Brewquester will ask for consent before the change applies.

18. Applicable law and final provisions

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country in which the user has their habitual residence remain unaffected. If a provision of these Terms is invalid, the remaining provisions remain effective. Statutory rules apply in place of the invalid provision.
